Lawsuit Alleges OpenAI’s Unauthorized Use of Copyrighted Material in Training AI Chatbot

OpenAI, a leading artificial intelligence organization, has been sued by two U.S. authors in a proposed class action filed in a San Francisco federal court. The authors, Paul Tremblay and Mona Awad, claim that OpenAI infringed upon their copyrights by utilizing their works to “train” its widely used generative AI system called ChatGPT.

According to the lawsuit, ChatGPT accessed data extracted from thousands of books without obtaining the necessary permissions, resulting in a violation of the authors’ exclusive rights. This legal action adds to the growing number of challenges related to the use of copyrighted material in training advanced AI systems. Similar lawsuits have been filed against OpenAI’s GitHub and Microsoft, as well as Stability AI, Midjourney, and DeviantArt by source-code owners and visual artists, respectively.

OpenAI and the other defendants have defended their practices, asserting that their systems adhere to the principles of fair use with regards to copyrighted works. ChatGPT, renowned for its conversational responses to user prompts, achieved remarkable popularity and became the fastest-growing consumer application in history. Within a mere two months of its launch, it amassed 100 million active users by January of this year.

Generative AI systems like ChatGPT rely on vast amounts of scraped internet data to generate content. Tremblay and Awad’s lawsuit emphasizes the significance of books as a “key ingredient” in the training process due to their exemplary long-form writing. The complaint alleges that OpenAI’s training data comprises more than 300,000 books, including those sourced from illicit “shadow libraries” that offer copyrighted works without authorization.

Mona Awad is acclaimed for her novels, including “13 Ways of Looking at a Fat Girl” and “Bunny,” while Paul Tremblay’s works encompass “The Cabin at the End of the World,” which was adapted into the film “Knock at the Cabin” directed by M. Night Shyamalan and released in February.

Tremblay and Awad contend that ChatGPT is capable of generating “highly accurate” summaries of their books, suggesting that their literary works were utilized in the training dataset.

The lawsuit seeks unspecified monetary damages on behalf of a nationwide class of copyright owners whose works were allegedly misused by OpenAI.
